THESE TERMS CONDITIONS AND OFFICIAL RULES ARE SUBJECT TO CHANGE WITHOUT NOTICE, FROM TIME TO TIME IN OUR SOLE DISCRETION. WE WILL NOTIFY YOU OF AMENDMENTS TO THESE TERMS AND CONDITIONS BY POSTING THEM TO THIS PAGE. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT JOIN OR ACCESS THIS WEBSITE AND ENTER THIS CONTEST (BEAUTY TRANSFORMATION LAB MAKEOVER).

1. NO PURCHASE NECESSARY TO ENTER OR TO WIN.

A purchase will not increase your odds of winning. All federal, state, local and municipal laws and regulations of South Korea apply. Void where prohibited.

2. Sponsors

Beauty Model Lab Contest is sponsored by TL PLASTIC SURGERY, ASTUTR CO. LTD (“My Seoul Secret”) and our participating sponsors (“Contest Sponsors”). Selection of winners and all other aspects of the Contest shall be final and binding on entrant in all respects. Neither TL PLASTIC SURGERY, ASTUTR CO. LTD, nor Contest Sponsors will be responsible for typographical, printing or other inadvertent errors in these Terms, Conditions and Official Rules or in other materials relating to the Contest. 3. Eligibility

The Beauty Model Lab Contest is open to individuals 18 years or older, but no older than 45, at the time of entry and is only open to non-South Korean citizens. And participants must have passports, and an ability to obtain visas to legally travel to South, Korea. In addition, applicants must be meet these qualifications:

1. Become a member at myseoulsecret.com
2. Present a medical certificate from no more than 6 months prior to entry verifying the candidate is in good health and possesses no pre-existing medical conditions. This must follow and meet TL Plastic Surgery Doctors guidelines, and terms and conditions.
3. Have a clean criminal history.
4. Have Internet access be savvy and or competent in using Facebook, Twitter, Google Plus, Instagram, Pinterest, etc.
5. Have the ability to stay in Korea for at least 1 month without any problems.
6. Have a passport with validity of at least 6 months upon the last day of application (31 August 2015).
7. You must provide true, accurate, and complete information, including personal and medical information.
8. You must not have any signed contracts with others or other similar contests that prevent you from participating in our contest.

4. Entry. The Contest begins at 12:01 a.m. (KST) on August 7, 2015 and all entries must be received by 11:59 p.m. (KST) on August 31, 2015. Individuals may enter this Contest by filling out the Official Entry Form. Each individual can enter only once. No one is permitted to submit an entry on behalf of another individual for any reason. Any entry must be submitted by entrant only and any entry submitted by an individual other than the subject will void such entry. In case of dispute as to identity of an entrant, such entry will be declared made by the registered user of the e-mail account, and if a prize is won, and such registered user is a valid entrant, the prize will be awarded to such registered user. Registered e-mail account holder is the natural person who has been assigned an e-mail address by an e-mail provider. All online entries will be declared made by the registered user of the e-mail address. Any questions regarding the number of entries submitted or the owner of an email account shall be determined by TL Plastic Surgery and My Seoul Secret in its sole discretion, and TL Plastic Surgery and My Seoul Secret reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.

Internet Entry: Enter by visiting the official registration page on the Beauty Model Lab Contest webpage on myseoulsecret.com and access the Official Entry Form. Complete the Official Entry form by following the instructions on the website. Your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking. By entering, you agree to these Terms, Conditions and Official Rules and to receive e-mails from TL Plastic Surgery and My Seoul Secret or Contest Sponsors or those directed to them. You can opt-out of the receipt of such e-mails by following the directions on the Contest website or in any email received from TL Plastic Surgery and My Seoul Secret of Contest Sponsors.

TL Plastic Surgery and My Seoul Secret and Contest Sponsors will not be responsible for incomplete, lost, late, “post-due,” misdirected or illegible entries or for failure to receive entries for any reason, including but not limited to transmission or technical failures or malfunctioning of any telephone connection, network, hardware or software. All entries become the property of TL Plastic Surgery and My Seoul Secret and no portion of the entry will be returned.

5. Prizes and Odds.

• Two Grand Prize Winners will receive an “Beauty Transformation Makeover Package” (approximate retail value $10,000 – $35,000 USD and will be selected by a committee formed by TL Plastic Surgery and My Seoul Secret from among 12 (updated* Sep 12 2015) finalists chosen using the following criteria:
  • Completeness of application
  • Application contents
  • User activity on myseoulsecret.com
  • Photos and prior medical history

• 12 Finalists will be chosen on or about September 11, 2015. Two Grand Prize Winners will be selected from the 12 selected finalists. Grand Prize Winners may receive one or more of the following services: facial plastic surgery, body contouring and augmentation or applicable services.

• Two other finalists will receive a 70% discount certificate and eight will receive 50% discount certificate on any treatment and procedure at TL Plastic Surgery that is valued over $4,000 USD (updated* Sep 12 2015 ).

• Odds of winning depend on the number of eligible entries received.

6. Winner Notification and Acceptance. Finalists will be notified by phone and/or email. If a potential winner does not respond to notification (with all requested information) within ten (10) days, such potential winner will be disqualified and an alternate winner selected. Forfeiture of prize and the selection of an alternate (provided sufficient eligible entries are received) winner may result from any of the following: entrant:

1. Fails to respond to a notification (with all requested information) within the required time;
2. Is sent an email notification that is returned as undeliverable after three (3) attempts;
3. Fails to complete and return a required Affidavit of Eligibility and Liability and Publicity Release (and any other documents, if requested) within the required time;
4. Is sent a prize notification/documentation that is returned as undeliverable for any reason;
5. Is deemed ineligible or cannot be notified or contacted;
6. Is unable to provide satisfactory proof that he/she is the authorized account holder of the email address
7. Is not available to have procedures performed on the dates and times specified by TL Plastic Surgery and My Seoul Secret;
8. Fails to respond to any other required time periods or is otherwise not in compliance with the Official Rules.

6.1. Rules for Winners and Finalists.

For the two qualified finalists to receive the head-to-toe transformation, they must comply with the rules and regulations of TL Plastic Surgery and My Seoul Secret:

1. Winners and Finalists must be arrive in Korea in October 2015 to receive facial and body surgery under the supervision of the doctors at TL Plastic Surgery. You need to have a visa to be able to stay in Korea for at least 1 month. You are responsible for visa fee.
2. This award/privilege can’t be transferred to other persons.
3. The three selected finalists agree to give the Beauty Model Lab Contest, TL Plastic Surgery, My Seoul Secret and Contest Sponsors the right to use names, images, video and/or audio recorded during the trip for display, public relations via online and offline media, and domestic and international marketing without any approval and extra compensation
4. All winners and finalists must follow our rules and conditions.
5. Beauty Model Lab Contest may change some of rules and conditions at any time.
6. The prize is nontransferable and cannot be exchange for cash. The finalists shall bear any/all income tax imposed according to the Revenue Code of Korea and under the agreed conditions.
7. The person in the submitted photos and present for the video conference must be the same person as the qualified candidate.
8. The finalists agree to give the Beauty Model Lab Contest the right to use names, images, video and/or audio before and after surgery for display, public relations via online and offline media, and domestic and international marketing without any approval.
9. In the event the project later finds that the candidate has not adhered to the rules and regulations of the contest or has intended to deceive the project, the committee has the right to disqualify the candidate immediately. Candidates cannot file claims under any circumstances, while the project holds full rights to recover damages and prosecute candidates according to the law.
10. The above conditions can be changed without prior notice.
11. The discretion of the committee will be used to make the final decision. Under no circumstances do candidates have the right to contest the project’s decision.

Winners are solely responsible for reporting and payment of any taxes on prizes. Winner will be solely responsible for all necessary travel and other expenses incurred in connection with accepting the treatment.

Winners will be required to sign and return an Affidavit of Eligibility and a Liability and Publicity Release which must be returned within ten (10) days following the date of first attempted notification. 7. Participation. By participating (submitting an application and creating an account on MySeoulSecret.com), entrants agree to be bound by these Official Rules and the decisions of the committee. TL Plastic Surgery and My Seoul Secret reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by TL Plastic Surgery and My Seoul Secret. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of TL Plastic Surgery and My Seoul Secret which corrupts or impairs the administration, security, fairness or proper operation of the Contest, TL Plastic Surgery and My Seoul Secret reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, TL Plastic Surgery and My Seoul Secret reserves the right to award prizes based on the entries received before the termination date.

8. Copyright. By entering the Contest, each entrant grants to TL Plastic Surgery and My Seoul Secret and Contest Sponsors an exclusive, royalty-free and irrevocable right and license to publish, print, edit or otherwise use the entrant’s submitted entry, in whole or in part, for any purpose and in any manner or media now known or hereinafter developed (including, without limitation, the Internet) throughout the world in perpetuity, and to license others to do so, all without limitation or further compensation for a period of 3 years starting from October 31, 2015. If his/her entry is selected as the winning entry, entrant will sign any additional license and release that TL Plastic Surgery and My Seoul Secret and Contest Sponsors may require to provide that TL Plastic Surgery and My Seoul Secret and the Contest Sponsors, may use entrant-winner’s name, biographical information, address, picture/photograph likeness (including before, during and after photographs), video footage and/or voice, for advertising and promotional purposes without further consideration to entrant-winner in connection with entrant-winner’s use and acceptance of the prize. After the three year period any published material on either TL Plastic Surgery, My Seoul Secret and sponsor channels that was published between Oct 31, 2015 to Oct 31, 2018 will remain unless requested by finalists and participants to be removed. Requests for removal can be sent to [email protected].

9. Limitations of Liability. By entering the Contest, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. BY ACCEPTING THE PRIZE, THE WINNER AGREES THAT TL PLASTIC SURGERY AND MY SEOUL SECRET, CONTEST SPONSORS AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS CONTEST OR PARTICIPATION IN ANY CONTEST OR PRIZE RELATED ACTIVITY.

10. Construction. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, Conditions and Official Rules, or the rights and obligations of any entrant and TL Plastic Surgery and My Seoul Secret or Sponsors, shall be governed by, and construed in accordance with the laws of South Korea, without giving effect to any choice of law or conflict of law rules or provisions. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the valid or enforceable provision was not contained therein.

11. Severability. If any provision of these contest Terms, Conditions and Official Rules is held to be illegal, invalid or unenforceable, (i) that provision shall be deemed amended to achieve as nearly as possible the same economic effect as the original provision, and (ii) the legality, validity and enforceability of the remaining provisions of these terms and conditions shall not be affected or impaired thereby

12. General Release. By entering the Contest, entrants release TL Plastic Surgery and My Seoul Secret, Contest Sponsors and any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

13. Changes. TL Plastic Surgery and My Seoul Secret shall have the right, at our discretion, to change the rules of a competition while it is running if it appears to them that it would be equitable or appropriate to do so, including the extension of the closing date whereupon there will be an announcement of any such extension at the first reasonable opportunity. No correspondence will be entered into or comment issued on any matters concerning any competition, and no reasons given for any decision made by TL Plastic Surgery and My Seoul Secret (updated* Sep 12 2015).
